CurbScope Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and CurbScope ("CurbScope," "we," "us," or "our") governing your access to and use of the CurbScope application, website, and related services (collectively, the "Service"). By creating an account, tapping "Accept," or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service Is

CurbScope provides information about real property — ownership, sale history, physical characteristics, and related records — compiled from government and other public sources, together with optional contact-lookup features. The Service is an information tool. It is not a consumer reporting agency, and nothing in the Service is a "consumer report" under the Fair Credit Reporting Act (FCRA).

2. Eligibility and Accounts

You must be at least 18 years old to use the Service. You are responsible for your account credentials and for all activity under your account. Provide accurate registration information and keep it current. We may refuse, suspend, or terminate accounts at our discretion, including for any violation of these Terms.

3. Permitted and Prohibited Uses

You may use the Service only for lawful purposes. Without limiting the foregoing, you agree that you will NOT use the Service or any data obtained through it to:

• Stalk, harass, intimidate, threaten, or surveil any person. Using property or contact information to locate, follow, monitor, or intimidate an individual is strictly prohibited and may constitute a crime under federal and state law.
• Discriminate. You may not use the Service to discriminate against any person or household on the basis of race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by the federal Fair Housing Act, the Equal Credit Opportunity Act, or applicable state or local law — including in advertising, steering, lending, tenant screening, or any housing-related decision.
• Violate telemarketing and communications law. See Section 4 (Do Not Call and TCPA Compliance).
• Make employment, credit, insurance, tenancy, or other FCRA-governed eligibility decisions. The Service is not FCRA-compliant and must never be used for these purposes.
• Resell, redistribute, scrape, bulk-export, or systematically copy data from the Service without our prior written consent.
• Circumvent, disable, or interfere with security features, rate limits, or metering of the Service, or access the Service by automated means except through interfaces we provide.
• Impersonate any person, misrepresent your affiliation, or use the Service to send spam or unsolicited commercial messages in violation of law.
• Use the Service in any way that violates any applicable federal, state, or local law or regulation.

4. Do Not Call and TCPA Compliance

If you use contact information obtained through the Service to place calls or send texts, you are solely responsible for complying with all applicable telemarketing laws, including:

• The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, including its restrictions on autodialed calls, prerecorded messages, and text messages without the required consent;
• The Telemarketing Sales Rule (TSR) and the National Do Not Call Registry;
• State do-not-call lists and state telemarketing statutes, including the Florida Telephone Solicitation Act (FTSA), which may be stricter than federal law;
• All call-time, disclosure, identification, and record-keeping requirements applicable to your calls.

CurbScope may display do-not-call flags or litigator indicators sourced from third parties. These flags are informational aids only. They may be incomplete, outdated, or wrong, and displaying (or failing to display) a flag is not legal advice and does not shift compliance responsibility to CurbScope. Scrub your own lists, obtain required consents, and consult your own counsel. You bear all liability arising from your calls, texts, mailings, and other outreach.

5. Data Accuracy — No Warranty

Data in the Service is compiled from public records and third-party sources, including county property appraiser, clerk, GIS, census, school, transit, and environmental datasets. Public records contain errors, and there is lag between real-world events and record updates. CurbScope does not verify, and does not warrant, the accuracy, completeness, timeliness, or fitness of any data. Ownership, valuation, sale, school, environmental, and demographic information may be outdated or incorrect. Do not rely on the Service as the sole basis for any financial, legal, or safety decision. Verify independently with the official source of record before acting.

6. Subscriptions, Credits, and Billing

Paid plans renew automatically each billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. Lookup credits are a limited license to use a feature of the Service; they have no cash value, are non-transferable, and expire when your account closes. Prices may change with notice effective at your next renewal. Usage limits (including view and lookup metering) are part of the Service and may not be circumvented.

7. Intellectual Property

The Service — including software, design, branding, and the selection and arrangement of data — is owned by CurbScope or its licensors and protected by intellectual-property law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your own lawful use consistent with your plan. All rights not expressly granted are reserved. Underlying public records remain public; what you may not do is copy or redistribute the Service's compiled databases, outputs, or design at scale.

8. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service you consent to that collection and use. If you obtain personal information about others through the Service, you are an independent controller of that information and solely responsible for handling it lawfully.

9. Enforcement and Penalties

We take misuse seriously. If we determine, in our sole discretion, that you have violated Section 3 or 4 (or any other provision of these Terms), we may without notice: suspend or permanently terminate your account and any associated accounts; revoke unused credits without refund; preserve and disclose records related to your use; and cooperate fully with law enforcement, regulators, and civil litigants, including in response to subpoenas, court orders, and lawful requests concerning stalking, harassment, telemarketing violations, discrimination, or other unlawful conduct. We may also pursue any other remedy available at law or in equity.

10. Third-Party Services

The Service depends on third-party providers (payment processing, authentication, data vendors, mapping). Their availability is outside our control, and their own terms may apply to your use of their features. We are not responsible for third-party services.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL BE ACCURATE OR COMPLETE. NOTHING IN THE SERVICE IS LEGAL, FINANCIAL, TAX, OR INVESTMENT ADVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURBSCOPE AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You will defend, indemnify, and hold harmless CurbScope and its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service or any data obtained through it; (b) your calls, texts, mailings, or other outreach to any person; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction and venue there. YOU AND CURBSCOPE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, TO THE EXTENT PERMITTED BY LAW. Claims must be brought within one year after they accrue.

15. Changes to the Service and These Terms

We may modify or discontinue features at any time. We may update these Terms; if we make material changes, we will notify you through the Service or by email, and the updated Terms take effect when posted (or a later stated date). Continued use after the effective date is acceptance of the updated Terms.

16. Termination

You may stop using the Service and close your account at any time. Sections that by their nature should survive termination (including Sections 5, 9, and 11–14) survive.

17. General

These Terms are the entire agreement between you and CurbScope regarding the Service. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
